网售食品要实名新《食品安全法》第六十二条第一款明确：网络食品交易第三方平台提供者应当对入网食品经营者进行实名登记，明确其食品安全管理责任;依法应当取得许可证的，还应当审查其许可证。互联网时代，颠覆了很多传统和习惯。点点鼠标，全世界的美食火速被传递到家门口。网购食品以省钱、方便，让不少吃货大饱口福，但也潜藏了不少风险。目前，“三无”食品大量充斥网店，记者在淘宝网站输入“自制食品”，有大量售卖页面，其中很多是自产自销、脱离市场质量部门监管的“三无”食品。在很多产品页面上，卖主只注明了该产品类别、净含量，但生产许可证编号、产品标准号、厂名、厂址、联系方式、储存方式、保质期等重要信息大多空白。而新法明确，网络食品交易第三方平台提供者应当对入网食品经营者进行实名登记、审查许可证。“消费者通过网络食品交易第三方平台购买食品，其合法权益受到损害的，可以向入网食品经营者或者食品生产者要求赔偿”。简而言之，这些自产自销的卖家将和网络食品交易第三方平台“绑”在一起——第三方平台有责任进行实名登记，依法应当取得许可证的，还应当审查其许可证，双方明确食品安全管理责任;一旦卖主出现食品质量的纠纷投诉，根据第一百三十一条第二款规定，网络第三方平台先行赔付。一、从事网络餐饮经营应遵循什么规定从事网络餐饮经营的餐饮服务提供者应遵守以下规定：1、应当具有实体经营门店并依法取得食品经营许可证；2、按照食品经营许可证载明的主体业态、经营项目从事经营活动，不得超范围经营。网络餐饮服务第三方平台提供者应当设置专门的食品安全管理机构，配备专职食品安全管理人员，每年对食品安全管理人员进行培训和考核。培训和考核记录保存期限不得少于两年。}
