1)保单和提单不一样,有没有TO ORDER都一样的,即,记名抬头和记名指示抬头的记名人都可以背书转让保单,或行使保险索赔权。当然,如果怕开证行无理挑剔带来的麻烦,记名指示要求时,做单时也不妨加上TO ORDER.
2)第1、2种不出现受益人名称,他成了支付保险费的投保人。个人认为对受益人来说似乎不如常规的做法好,即做成受益人抬头,然后受益人背书给开证行;第3种最好避免,如果开证行想独自控制保单的索赔权和转让权,那么空白背书不能实现开证行的意图。毕竟空白背书不是开证行所要求的,尽管在顺利的情况下可能对开证行更好,最好不要这样;第4种,如果你指的是“保单背面APPLE CO LTD 背书 成&&IN FAVOR OF issuing bank ABC”而不是“受益人在保单背面背书成APPLE CO LTD&&IN FAVOR OF issuing bank ABC”那么,那正是在该信用证条款下的常规做法。
