我跟卖了貌似是宜家的东西，我看别人都在跟卖，而且图片上和我的产品一模一样，这样有问题吗，他只是在标题写了IKEA的字样，今天收到这个通知，要怎么解决好，我是从阿里巴巴拿货的，请问是直接去联系阿里巴巴的那个卖家开发票，然后提交到后台，还是去宜家开发票提交给后台

专利维权红利期的释放者——亚马逊本身
亚马逊卖家遇见最多死账号的方式还是侵权死，最近亚马逊上侵权死有集中爆发的趋势，从多个卖家向小编反馈的情况来看侵权纠纷多发源于权利人嗅到了专利维权的红利，这个红利的释放者就是亚马逊本身——品牌备案(Brand Registry)陆续向各大站点放开，先是美国站，接下来欧洲、日本……
不光是亚马逊，速卖通、Wish也变得对侵权展现出了零容忍，这是跨境电商零售出口面临的新壁垒。
下面小编就以一位耳机套卖家的真实遭遇为大家扒一扒亚马逊上侵权投诉的那些套路，素材来自“向心力-小灰灰”向亿恩网独家提供。
一款产品如下图，耳机套。
之前这位卖家一直在出售这个产品，然后有人自称是Yellow Brand Protect 的人说这位卖家的这个产品侵权了，如果要想继续卖这个产品就要主动的去联系这个发邮件的人支付专利授权费用。
下图是“权利人”发给这位卖家的专利保护图：
这个卖家哪有那么小白，自己辛苦卖货攒下来钱哪能那么容易送给这人呢？
经过查询US（发明专利）的权利要求如下图：
在这款耳机套七项专利申请下，这位卖家的产品在它们权利要求之内。根据第3条分析（3. The ear unit according to claim 1, further comprising at least one unit from the group comprising ear phone and microphone. ）
小编推断收到这份邮件的耳机套卖家不在少数。
根据最近亚马逊针对专利侵权处理的情况来看，这款耳机的功能虽然在那款专利的保护范围之中，但是本质上不是同一产品，如果对方不请律师的话，只是专利方的投诉亚马逊应该不会处理。如果亚马逊处理了你的产品下架了，还是可以申述回来的。没有专利抵挡，就是这么被动呀……最后小灰灰建议可以不理对方，继续销售，但是减少库存以防万一。
专利之争旷日持久，我们见惯了苹果大战三星双方各有胜负，现在专利之争一定程度上演变成了一种竞争、限制对手的商业手段。还有更令卖家气愤的专利流氓，见你爆单就伺机讹诈，给钱就走。
据悉，现在亚马逊上出现了这样的一类人。先做好专利放在那里按兵不动，等到这个专利的产品有大的卖家出现或者这款产品爆单了压货在FBA后，他们就像苍蝇嗅到了食物一样去疯狂的投诉，收取专利授权费用。
亚马逊什么态度
首先亚马逊是一个很重视专利保护的平台，这么些年来一直呼吁卖家走品牌经营的路线，包括2016年开始的工厂招商计划，下沉供应链都是在避免这样低品质、低价竞争的上演。
如果卖家没有获得授权，侵权卖家又不去摆平。权利人第一步就是去亚马逊投诉，一般来说亚马逊会做出初步的判定，如果权利人证据充分，亚马逊一般都会采纳权利人的诉求，这也就避免了权利人下一步法院维权的升级，亚马逊顶不住来自美国、欧洲法院的起诉的，这也就解释了专利侵权会那么容易关店的原因。你见过历次的婚纱维权GBC告速卖通平台上的卖家、告eBay上的卖家、告阿里巴巴上的卖家、告敦煌网上的卖家，但你见过GBC告亚马逊平台上的卖家吗？
